Move it! AR consumer service

1. Controller

The controller responsible for the processing of personal data in connection with the Move it! AR service is:

Move it! AR is the trade name of a service provided by Gergö Fazekas Werbeagentur e.U. The MAJORDESIGN is a brand used by the company.

2. Which data do we process?

When using the Move it! AR website and when ordering and providing the service, the following personal data in particular may be processed:

  • name and email address;
  • data relating to the order and the Move it! AR project;
  • the selected activation date;
  • the image and video files uploaded by the user;
  • the payment status and payment-related transaction identifiers;
  • technically necessary data arising from the operation of the service, for example IP address and log data.

The uploaded image and video files may contain personal data. The user is responsible for holding the necessary rights to use the uploaded content and to process the image, voice or other personal data of the persons depicted.

3. Purpose and legal basis of processing

We process personal data for ordering and providing the Move it! AR service, for creating, reviewing and activating the project, for operating the AR function, for payment processing and for communication with the customer.

The legal basis for processing required for the performance of the contract or for pre-contractual measures is Art. 6(1)(b) GDPR.

Where the retention of certain data is required by accounting, tax or other legal obligations, the legal basis is Art. 6(1)(c) GDPR.

4. Uploaded image and video files

To use Move it! AR, the user can upload an image and a video. The image serves as the basis for the image recognition of the AR experience; the video is the content displayed in the AR experience.

The Move it! AR project is active for 30 days from activation.

We retain the image and video files uploaded for the project for a maximum of 60 days from activation. After the 30-day active period, the files may remain available for a limited time for technical and administrative reasons, but they are deleted no later than 60 days after activation.

The video files are stored on servers that are part of the technical infrastructure of Move it! AR and from which the AR system loads them during use.

5. Payment

Online payment is processed via the Stripe payment system.

The payment data required for payment processing is processed by the payment service provider. Move it! AR may process the transaction information required to handle the order – such as the payment status and the transaction identifier.

6. Camera use and AR function

The function of Move it! AR requires access to the camera of the user's device.

Using the camera, the system recognises the target image belonging to the AR project and displays the linked digital content.

Camera use requires permission on the user's device or in the user's browser.

7. Technical service providers

To operate Move it! AR we use external technical services and infrastructure, in particular:

  • Stripe – processing of online payments;
  • Google Analytics (Google Ireland Limited) – statistical analysis of website usage, exclusively with your consent;
  • Lovable and the associated cloud infrastructure – operation of the online interface and the upload system;
  • the provider of the technical server infrastructure of Move it! AR – storage and delivery of the digital content of the AR projects.

These service providers may access personal data to the extent required to provide the service.

8. Google Analytics

On the Move it! AR website we use Google Analytics – exclusively with your consent – to compile a statistical analysis of website usage. This helps us to further develop Move it! AR.

Google Analytics is not loaded and sends no data without your consent. If you reject the analytics cookies, Google Analytics remains fully blocked.

The legal basis for the processing is your consent (Art. 6(1)(a) GDPR).

You can withdraw your consent at any time via the "Cookie settings" link in the footer of the website.

The use of Google Analytics is not a prerequisite for using the website or ordering a Move it! AR project.

9. Retention period

We retain the image and video files uploaded for the project for a maximum of 60 days from activation.

Uploads for started but not completed projects may be stored for a limited time and then deleted.

We retain data required to fulfil contractual, accounting and tax obligations for the legally prescribed duration.

For Austrian tax-relevant documents, the general retention period is 7 years.

The deletion of a project's media files therefore does not necessarily mean the simultaneous deletion of all business and accounting data connected with the order.

10. Data disclosure

We only pass personal data on to service providers or other recipients to the extent required to provide the service, process online payments, operate the technology or fulfil legal obligations.

If a technical service provider processes personal data outside the European Economic Area, the transfer takes place in accordance with the relevant provisions of the GDPR.

11. Your rights

Under the GDPR you have, in particular, the right of access, rectification and erasure of your personal data, the right to restriction of processing and to data portability, and – depending on the legal basis – the right to object to processing.

If you believe that the processing of your personal data violates data protection law, you can lodge a complaint with the competent supervisory authority:

12. Changes to this notice

The provider is entitled to amend this privacy notice, in particular if the technical functioning of the service, the service providers used or the applicable legal provisions change.
